Lindquist & Vennum Intellectual Property attorneys

Our group does not prosecute patents; instead, we have elected to work on a case-by-case basis in association with some of the finest patent law firms in the world to defend and prosecute infringement lawsuits and to argue appeals before the Federal Circuit Court of Appeals in Washington, D.C.

It is our goal to help clients avoid lawsuits through strategic business counseling and analysis of potentially troublesome competing patents.

We handle licensing and other transactional work involving patents and assist clients in using the patents to their maximum advantage.

Recent successes in patent litigation include a victory in an arbitration on behalf of a group of licensees where the patent owner was improperly attempting to limit the scope of their license, choking off an important source of revenue. The firm was also a part of a team that successfully prevented a pharmaceutical manufacturer from enforcing a questionable patent against a generic equivalent, crafting and presenting the argument adopted by the court in denying the pharmaceutical company's effort to obtain an injunction and ultimately reaching an agreement that allowed our client to introduce its generic to the market.

We provide counseling on copyrightability, copyright ownership, registration, transfers, licensing, importation, fair use and the specialized area of copyright security interests.

Most businesses today create and use copyrightable works; our goal is to assist our clients in maximizing the benefits they obtain from computer software, video displays, package designs, compilations of important factual information and traditional artistic works such as songs, films, books and art.

We have the specialized knowledge and experience in the growing area of law related to "bits and bytes" essential to every business with a presence on the World Wide Web and Internet.

We have represented clients in copyright lawsuits involving domain names, architectural designs, product catalogs, sculptures, inflatable amusement park slides and Internet linking and framing issues.

Our group's recent successes include obtaining an order leading to the impoundment and destruction of "knock-off" sculptures as they were imported from another country; a jury verdict for a contractor whose unique design of a luxury home had been pirated by a competitor; and a judgment and award of attorney fees when a competitor brazenly copied a client's agricultural products catalog—then refused to withdraw it from circulation.

We also defend companies against exaggerated allegations of infringement by the so-called "software police." On several occasions we obtained inexpensive and confidential settlements. We have successfully defended clients whose competitors have misused their copyrights to attempt to obtain an unfair market advantage.
